Age Restrictions & Verification:

  • Age Restriction: This website is intended for persons 21 years of age or older (or the legal minimum age to purchase vapor/tobacco products in your jurisdiction – whichever is greater) only.
  • Verification: We use age verification systems to abide by federal and state laws. To ensure that your order can be placed and shipped, you might need to present proper government-issued ID to ascertain your age.

Accounts, Pricing and Payments:

  • The security of User Accounts: Users must keep the information of their accounts confidential. If you engage in any fraudulent, abusive or illegal activity you may be terminated from your account.
  • Payment Methods: At checkout we accept major credit cards (Visa, MasterCard, Discover and American Express) and authorized digital payment options. All payment is due at the time of order.
  • Currency: All prices, taxes and transactions will be in USD (U.S. dollars). Errors are typographical and illustrative errors. We are able to correct any pricing errors and cancel any order placed with incorrect pricing.

Shipping, Delivery and Hazardous Materials:

  • Fulfillment: We will process standard orders in 1-2 business days and deliver them to you as soon as possible. Mods and Pods cannot guarantee that delivery will occur on time if weather conditions, carrier delay or seasonal volume surges cause delays.
  • Shipping Restrictions: We can only ship to compliant residential addresses due to federal, state and local regulations (PACT Act). Hazardous materials are not shipped outside of the 48 contiguous United States. Orders containing regulated hazardous materials (such as certain batteries or e-liquids) may incur an extra carrier handling fee, which will be charged at checkout.
  • Customer Responsibility: Buyer is responsible for the accuracy of shipping address.

Damaged Goods, Refunds and Returns:

  • Damaged or Missing Items: If any items are damaged or missing, please check the order as soon as it is received. The Customer Support team has to be notified of any missing items, error or damage during shipping within 48 hours of delivery. Please keep all original packaging.
  • DOT regulations: Regulated hazardous materials (including e-liquids and devices with internal batteries) must be returned by other means than regular mail. Defects or shortcomings that have been approved will be addressed through a store credit or refund.
  • Perishable Goods: All perishable products (e-liquids, disposable vapes, coils etc.) have final sale dates as per health and safety regulations.
  • Return Shipping & Restocking: If the item is not defective or opened, the buyer bears all return shipping costs, and can expect a 10% restocking fee.

Compliance with Local Laws:

Vapor and e-cigarette laws differ from one jurisdiction to another. The Buyer shall ensure that the purchase and receipt of our products conforms with all local laws and restrictions in the Buyer’s area. Orders which are in conflict with local regulations are subject to cancellation.

Limitation of Liability:

  • No Consequential Damages: Mods and Pods shall be held free from liability for any indirect, incidental, punitive or consequential damages which flow from the use, misuse, or consumption of our products.
  • Maximum Liability: The maximum liability of Mods and Pods for any claim shall be the actual purchase price paid by the customer for the specific product in question.

The contents, graphics, logos, layouts and digital materials in this website are the property of Mods and Pods. All portions of this web site are subject to copyright regulations and may not be reproduced and/or copied without our written permission.

The governing law and jurisdiction:

The laws of the USA state without any reference to its conflict of law rules, shall govern and be interpreted in reference to these Terms and Conditions. All claims and other legal proceedings stemming from the use of these Terms shall be brought in civil court before the State or Federal courts in the city.
